Terms and conditions of user agreement comprising of rules and regulations and privacy policy are published in compliance with the statutory requirement under the Information Technology Act, 2000 and Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 as applicable and amended from time to time. This Agreement does not require any physical or digital endorsement by signature. By accessing this website www.uniherbs.in (“Website”) (whether or not using the services/purchasing the products), you have agreed to the terms and conditions of this Agreement. You may choose not to access the Website if you do not agree with the contents of this Agreement.

Use of Personal Information:

This Website is owned and controlled by Uniherbs India and we at Uniherbs India (“we”/”us”/”our”) respect your privacy and always endeavor to take due care with respect to the confidentiality of personal information shared by you on our Website.

This Agreement comprising the Privacy Policy herein provides concisely, the manner in which your data is collected and used by us on the Website. As a customer/visitor to the Website (“you”/”your”), you are advised to please read this Agreement carefully. By accessing the services provided by the Website you have agreed to the collection and use of your data by us in the manner provided in this Agreement.

Account & Registration Obligations:

All customers have to register and log in for placing orders on the Website. You have to keep your account and registration details current and correct for communications related to your purchases from the Website. By agreeing to the terms and conditions, the customer agrees to receive promotional communication and newsletters upon registration. The customer can opt-out either by unsubscribing in “My Account” or by contacting customer service.

Pricing:

All the products listed on the Website will be sold at MRP unless otherwise specified. The prices mentioned at the time of ordering will be the prices charged on the date of the delivery.

Cancellation by Website / Customer:

You as a customer can cancel your order anytime up to the cut-off time of the slot for which you have placed an order by calling our customer service. In such a case we will refund any payments already made by you for the order. If we suspect any fraudulent transaction by any customer or any transaction which defies the terms & conditions of using the website, we at our sole discretion could cancel such orders with/without providing any notification to the Customer. We will maintain a negative list of all fraudulent transactions and customers and would deny access to them or cancel any orders placed by them.

Return & Exchange:

Any defect or complaints can be referred to the company’s customer care cell at +919898384106 or can be emailed to us at info@uniherbs.in. The customer’s complaints will be redressed as soon as possible. The customer may return the product within 7 days of receipt in case of any defect by raising a complaint and returning the product on a ‘freight to pay basis. When returning goods, please quote the – order number, your name, name of the product, and the reason why you are returning the goods. The company will refund the money net off freight paid by it on such returns.

For all orders which could not be executed or refused at the destination, the amount collected would be refunded after deducting the shipping and handling charges.

Returns are not possible in the following cases:

• Used products.
• Return request is made outside the specified time frame.
• Products with tampered or missing serial numbers, including price tags & labels.

You Agree and Confirm:

• If a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information) any extra cost incurred by us for redelivery shall be claimed from you.
• That you will use the services provided by the Website, its affiliates, consultants, and contracted companies, for lawful purposes only and comply with all applicable laws and regulations while using and transacting on the Website.
• You will provide authentic information in all instances where such information is requested of you. We reserve the right to confirm and validate the information and other details provided by you at any point in time. If upon confirmation your details are found not to be true (wholly or partly), we have the right in our sole discretion to reject the registration and debar you from using the services and/or other affiliated websites without prior intimation whatsoever.
• That you are accessing the services available on this Website and transacting at your sole risk and are using your best and prudent judgment before entering into any transaction through this Website.
• That the address at which delivery of the product ordered by you is to be made will be correct and proper in all respects.
• Before placing an order you will check the product description carefully. By placing an order for a product you agree to be bound by the conditions of sale included in the item’s description.

Colours:

We endeavor to make every effort to display the colours of our products that appear on the Website as accurately as possible. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor’s display of any colour will be accurate.

Modification of Terms & Conditions of Service/ User Agreement:

We may at any time modify the Terms & Conditions of Use/ User Agreement without any prior notification to you. You can access the latest version of these Terms & Conditions at any given time on the Website. You should regularly review the Terms & Conditions on the Website. In the event the modified Terms & Conditions is not acceptable to you, you should discontinue using this Website. Governing Law and Jurisdiction:

This User Agreement shall be construed following the applicable laws of India. The Courts at Vadodara shall have exclusive jurisdiction in any proceedings arising out of this agreement. Any dispute or difference either in interpretation or otherwise, of any terms of this User Agreement between the parties hereto, the same shall be referred to an independent arbitrator who will be appointed by us and his decision shall be final and binding on the parties hereto. The above arbitration shall be under the Arbitration and Conciliation Act, 1996 as amended from time to time. The arbitration shall be held in Vadodara. The Court of Vadodara alone shall have the jurisdiction and the Laws of India shall apply.

Reviews, Feedback, Submissions:

All reviews, comments, feedback, postcards, suggestions, ideas, and other submissions disclosed, submitted or offered to the Website on or by this Website or otherwise disclosed, submitted or offered in connection with your use of this Website (collectively, the “Comments”) shall be and remain our property. Such disclosure, submission, or offer of any Comments shall constitute an assignment to us of all worldwide rights, titles, and interests in all copyrights and other intellectual properties in the Comments. Reservations:

• We reserve the right to impose limits on the number of transactions or transaction price which we may receive from an individual Valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual customer during any time period and reserve the right to refuse to process transactions exceeding such limit.
• We reserve the right to refuse to process transactions by customers with a prior history of questionable charges including without limitation breach of this Agreement by the customer or breach/violation of any law or any charges imposed by issuing bank or breach of any policy.
• We may delay notifying the payment confirmation i.e. informing the seller to dispatch if we deem suspicious or for Buyers conducting high transaction volumes to ensure the safety of the transaction and transaction price.

Disclaimer:

It is agreed and understood by you that all contents of the Website are offered on an “as is” basis without any warranty whatsoever either expressed or implied by us. You further understand and acknowledge that we make no representations and/or warranties, express or implied, including without limitation originality, purity, and freshness for a particular purpose.
